Art Sales Vault (“ASV,” “we,” “us,” or “our”) owns and operates https://www.artsalesvault.com/ (the “Site”), and provides related products, services, newsletters, and other offerings (collectively, including the Site, the “Services”). Please read our Terms of Use for detailed information about our Services and your legal obligations.
This Privacy Policy (the “Policy”) applies to the Site and Services owned, operated, and provided by ASV. We have created this Policy to provide you information on how we collect, use, and share personal information. This Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with: their practices are outlined in their own privacy policies. Capitalized terms not defined in this Policy have the meaning provided by our Terms of Use. By using the Site and/or the Services, you are agreeing to the terms of this Policy and the accompanying Terms of Use. We encourage you to read this Policy, and to use the information it contains to make an informed decision.
INFORMATION WE COLLECT OR RECEIVE AND HOW WE USE IT.
Information You Provide to Us. We collect personal information provided by you voluntarily while using the Services (collectively, the “Personal Information”). Such Personal Information may include:
  • Name, email address, and any other information you provide by completing ASV forms.
  • Billing information, such as your credit card number or billing address (collectively, “Payment Information”).
  • Work or professional information, such as your company, employer, or job title.
  • Unique identifiers, such as username and password.
  • Details of transactions and preferences from your use of the Services.
Information Obtained from Third-Party Sources. We may obtain information about you from third parties, including but not limited to information from public domain data contained within media sources and from our clients in connection with providing the Services (collectively, “Third-Party Information”). We will only use such information for the purpose of providing Anti-Money Laundering (“AML”), escrow, and related transactional services.
Information Collected by Automated Means. In addition to the Personal Information, Payment Information, and Third-Party Information, we may automatically collect or receive additional information regarding you and your use of the Site and/or Services, and information regarding the technology you use to access the Site and/or Services (collectively, the “Other Information”). Such Other Information may include:
From You. Additional information about you that you voluntarily provide to us, such your product and service preferences.
From Your Activity. We may collect or receive information regarding:
  • Internet protocol (IP) address, which may consist of a static or dynamic IP address and will sometimes point to a location or specific identifiable electronic device.
  • Browser type and language.
  • Referring and exit pages and URLs.
  • Date and time of the activity.
  • Details regarding your activity on the Site or using the Services, such as search queries and other performance and usage data.
About Your Device. We may collect or receive information regarding:
  • The type of device you use to access the services.
  • Advertising Identifiers (g.,IDFA” or “AdID”).
  • Your device’s operating system and version.
  • Your mobile device carrier.
  • Your network type (for example, WiFi, 3G, 4G, 5G, LTE, etc.).
From Cookies. We use WordPress, SiteGround and Digital Ocean to power our Site. These technologies use cookies to ensure that its sites, including our Site, run effectively. SiteGround’s data privacy and collection practices are governed by its own Privacy Policy, and Terms of Service. WordPress, SiteGround and Digital Ocean are not affiliated with ASV.
 The technologies we use for automatic data collection may include:
  • Digital Ocean. We use Digital Ocean to host elements of the Site and Services. Digital Ocean may collect personal information, payment information, and personal data to provide, operate, and maintain its services; to improve, personalize, and expand its services; to understand and analyze how its services are used; to develop new products, services, features, and functionality; to communicate with customers; to process transactions; to send text messages and push notifications; to find and prevent fraud; and for compliance purposes. Digital Ocean’s ability to collect, use, and share information is restricted by its Terms of Service Agreement, Acceptable Use Policy, and Privacy Policy. ASV is not affiliated with Digital Ocean.
  • Django is a web development framework. It does not store any Personal Information or Other Information about You.
  • We use OpenSanctions to verify the background of parties to a transaction and ensure that transactions are legally compliant. OpenSanctions may collect personal information to provide services; in its or a third-party’s legitimate interests; to prevent and detect unlawful acts; where consent is given; or for compliance with legal obligations. OpenSanctions’s ability to collect, use, and share information is restricted by its Privacy Policy. ASV is not affiliated with OpenSanctions.
  • Stripe is used strictly for payment processing and collects only that information necessary to process payment for our Services. We will share your Payment Information with Stripe as necessary to process your payment. Stripe stores your Payment Information; we do not store this information. Storage by Stripe of your Payment Information is subject to the privacy policies and practices of Stripe and is not subject to the terms of this Privacy Policy. By providing your Payment Information, you acknowledge and agree to use of the information by Stripe for purposes of processing any payments to us.
  • WordPress provides the software hosted on SiteGroun used to run the front-end of our website. All sensitive AML related Personal Information is stored in Digital Ocean, not WordPress. WordPress’s privacy policy is found here and terms of use are found here.
HOW INFORMATION IS USED AND SHARED.
By using the Site and/or the Services, you give us permission to use the Personal Information, Payment Information, Third Party Information, and Other Information (collectively, the “Information”) to:
  • Set up and administer your account.
  • Provide and improve the Services, including but not limited to displaying content based on your previous transactions and preferences.
  • Provide and complete any purchased Services.
  • Answer your inquiries and provide customer service.
  • Inform you about our products and services through marketing and advertising, including but not limited to our newsletters (information about how to opt out of marketing communications is provided below).
  • Post testimonials about our Services (only with your express consent).
  • Prevent, discover, and investigate fraud, criminal activity, or violations of our Terms of Use.
  • Secure the Site and our Services.
There may be other instances where we share your personal data with third parties based upon your consent.
We engage third-party companies and individuals to perform functions on our behalf. Examples may include providing technical assistance, customer service, marketing assistance, and administration of promotional programs. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law.
ASV shares Information with third parties for business purposes in connection with providing the Services. We do not well, rent, or lease your personal data to third parties, nor do we transfer your personal data to third parties for direct marketing purposes.
We may share the Information with third-party service providers under contract to help provide the Services and assist us with our business operations (e.g., payment processing, due diligence investigations, and bill collection).
We may share some or all of your Information with any of our parent companies, subsidiaries, joint ventures, or other companies under common control with us.
As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Information may be part of the transferred assets. You will be notified via email and/or a prominent notice on the Site of any change in ownership, or uses of your Information, as well as any choices you may have regarding your Information.
Your Information may be shared with other users of the Services that you interact with to help you complete a transaction. This information is only shared with your permission.
To the extent permitted by law, we may also disclose the Information:

  • Whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of us or others, including you.
LEGAL BASES FOR PROCESSING FOR EUROPEAN ECONOMIC AREA USERS (“EEA”).
If you are an individual in the EEA or UK, we collect and process information about you only where we have legal bases for doing so under European Union and/or UK law. The legal bases depend on the Services you use and how you use them. 
HOW WE STORE AND SECURE YOUR INFORMATION.
We retain your Information for as long as your account is active or as needed to provide the Services. We will retain and use your personal data as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.
All Information you provide is stored on an encrypted server that meet some of the highest cybersecurity and data privacy standards available. We take your privacy seriously and only contract with third-party hosting services that do the same. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or databases of third parties with which we may share such Information, nor can we guarantee that Information you supply will not be intercepted while transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

Depending on your location, you may have certain rights regarding your Personal Information, including:
The right to access – You have the right to request ASV for copies of your personal data. We may charge you a small fee for this service.
The right to rectification – You have the right to request that ASV correct any information you believe is inaccurate. You also have the right to request ASV to complete the information you believe is incomplete.
The right to erasure – You have the right to request that ASV erase your personal data, under certain conditions.
The right to restrict processing – You have the right to request that ASV restrict the processing of your personal data, under certain conditions.
The right to object to processing – You have the right to object to ASV’s processing of your personal data, under certain conditions.
The right to data portability – You have the right to request that ASV transfer the data that we have collected to another organization, or directly to you, under certain conditions.

You will not be discriminated against for exercising any of your rights.
You may correct, update, amend, delete/remove, or deactivate your account and/or Personal Information by making the change on your Member’s Portal page on the Site, or by contacting us at our email: orders@artsalesvault.com. Please allow a reasonable amount of time for us to respond to your request.
You may choose to stop receiving ASV newsletters or marketing emails at any time by following the unsubscribe instructions included in those communications, or by contacting us here. ASV posts customer testimonials only with the customer’s prior consent. If you wish to remove Personal Information that is being publicly displayed on our Site or Services by contacting us at our email: orders@artsalesvault.com
You cannot opt out of receiving transactional e-mails related to the Site or the Services (for example, requests for support or payment receipts). You will not receive transactional e-mails if you deactivate your account.
We may request proof of your identity before acting upon any request. To submit a question or concern about your rights, please contact us at our email: orders@artsalesvault.com. If you live in the EEA, United Kingdom, or Switzerland, and you are unsatisfied with our response, you have the right to lodge a complaint regarding your Personal Information with an applicable supervisory authority.
EXTERNAL WEBSITES.
The Site may contain links to third-party websites. We have no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. We encourage you to check the applicable privacy policy and terms of use when visiting any other websites.
CHILDREN’S ONLINE PRIVACY PROTECTION ACT (COPPA).
The Site and the Services are not intended for use by children under the age of eighteen, and the Site and Services are not directed to children under the age of thirteen. We adhere to the Children’s Online Privacy Protection Act (COPPA) which prohibits the knowing collection of Personal Information from any child under the age of thirteen. We ask that minors (under the age of eighteen) not use the Services. If a child under the age of eighteen has provided us with Personal Information, a parent or guardian of that child may contact us and request that such information be deleted from our records.
CHANGES TO THIS PRIVACY POLICY.
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the App. By accessing the App after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information. Please refer back to this Privacy Policy on a regular basis.

IMPORTANT NOTICES TO NON-U.S. RESIDENTS.
The App and its servers are operated in the United States. If you are located outside of the United States, please be aware that your Information, including your Personal Information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to use the App, you hereby irrevocably and unconditionally consent to such transfer, processing, and use in the United States and elsewhere.
